 A commercial lease between a landlord and a tenant can become subject disputes, particularly if the lease agreement is unclear on any of the key issues. A dispute can cause financial hardship and loss of income for the landlord and could potentially cause the tenant’s livelihood to cease.
It’s therefore in the interests of both parties to come to a speedy solution, if the relationship is to be prevented from breaking down entirely.Â

How to prevent and resolve disputes
Giving the matter proper attention sooner rather than later can be key to resolving any differences amicably. Even if you believe you are in the right, keeping an open mind about compromising and all possible solutions will help. Sometimes it’s sufficient for the other party to believe that you are listening and appreciating their viewpoint, even if you aren’t willing to accede. Don’t underestimate the importance of good communication in protecting your rights and achieving a positive outcome.
How you choose to communicate is your decision but bear in mind that written letters, emails and texts can be misconstrued. However, having written evidence of what exactly was said can be useful if you need to pursue the case further, through to litigation.
If you can’t find a resolution to your dispute and you have to take the matter to court, a log of what happened and when will support your case strongly. It’s therefore advisable to start keeping a diary, with photos where relevant, as soon as you can. You should do this even if you hope to resolve the complaint without litigation as it’s better to be prepared.
